Based on Art. 260, item 1. of Criminal Justice Act, the Plaintiff is filing the following
C I V I L C O M P L A I N T
Filing criminal charges for an act against the Law according to the Art. 260, item 1 of Criminal Justice Act; filing a criminal procedure for an act of offence against the Animal Protection Act.
On July 3, 2007, at 9:00 A.M., the employees of Agricultural Cooperation Djurdjevac, accompanied by the police, seized around 60 cows on the property of Slavko Lukic in Molve Grede near Djurdjevac. On this occasion, the employees who were taking the cows from the stables and boarding them onto the transportation vehicle were beating the cows intentionally, brutally, and with no reason for some time, which was in no way connected to the standard procedure. They used wooden batons and were hitting the cows on the head, thighs, and other parts of their bodies, which was, in our opinion, a criminal act of serious animal abuse as described in the Criminal Justice Act, Art. 260, item 1. We do not know the exact identity of the mentioned employees of Agricultural Cooperation Djurdjevac.
The seizure was covered and photographed by photo-reporter Josip Maljak from Vecernji List, who then forwarded the photographs to us. We enclose one of these photographs as possible evidence. Photographs were also published in Vecernji List, Podravina-Bilogora edition, pages II and III, on July 4, 2007.
We have the opinion that the employees of Agricultural Cooperation Djurdjevac have also violated the Animal Protection Act, which is why we are also filing charges for an act of offence against the Law on these grounds.
The Plaintiff proposes to the District Attorney’s Office to launch an investigation on the above-mentioned criminal offence and punish the perpetrators.
