SUBJECT: DEMAND FOR OFFICIAL SUPERVISION
Animal Friends asks the above mentioned according to Article 60 of the Animal Protection Act (Official Gazette No. 135/06) to undertake urgent official supervision of the decision of the veterinary office which issued sanitary permission to the Circus Safari to perform in Croatia, despite not fulfilling the conditions from Article 53 paragraph (1) of Animal Protection Act (Official Gazette No. 135/06). On this basis the Border Veterinary control issued a Decision which approved temporary admission of the animals and above mentioned legal person to stay in Republic of Croatia.
EXPLANATION
The above mentioned legal person Circus Safari KEEPS wild animals which contradicts to Article 53 paragraph (1) of the Animal Protection Act (Official Gazette No. 135/06), which says, as first condition (causa sine qua non, meaning there is nothing possible without that condition), that KEEPING wild animals in circuses is prohibited.
As the Act does not foresee any conditions for excluding of the unlawfulness of the above mentioned regulation, the statement of the importer or any other written document would have the least judicial effect. Therefore, we ASK the above mentioned authorities to immediately revoke the issued Permission until the conditions for issuing are fulfilled.
